Build the timeline before the accounts diverge
Motorcycle collisions may involve a driver turning across the rider’s path, changing lanes, opening a door, or failing to see stopped traffic. Identify the rider’s lane, direction, speed evidence, visibility, and the other vehicle’s movement. A conclusion based only on the fact that someone was riding a motorcycle is not a substitute for examining those facts.
Preserve the motorcycle and riding equipment
- Keep photographs of the motorcycle, helmet, protective clothing, road surface, and impact locations.
- Before repairs or disposal, discuss whether an inspection is needed. Keep original camera recordings and photographs.
- Identify witnesses and nearby cameras promptly; footage may be overwritten.
- Document medical care, recovery restrictions, time away from work, and assistance needed at home.
Disputed fault and insurance
An insurer may dispute speed, visibility, lane position, or the cause of an injury. The response should connect each disputed point to evidence. Your attorney can also examine applicable liability and uninsured or underinsured motorist policies. Coverage and exclusions need review under the actual policy.
A serious injury does not establish a specific case value. Medical evidence, future care needs, income loss, responsibility for the crash, and available coverage all matter.
Deadlines deserve an early review
California’s general deadline for a personal injury lawsuit is two years. A claim involving a California public entity generally requires a separate government claim within six months of accrual, followed by additional lawsuit deadlines. Exceptions and other deadlines can apply; an insurance claim alone does not preserve every deadline. Code of Civil Procedure §335.1; Government Code §911.2.
Speak with the firm
- The date, location, and a short timeline of the incident.
- Photos, video, witness details, and any incident or police report number.
- Insurance letters, claim numbers, and any settlement or release you received.
- Available treatment records, bills, and information about missed work. You do not need a complete file to request a consultation.
An initial case review is free. Before representation begins, ask for the written fee agreement explaining attorney fees, litigation costs, and how any recovery would be distributed. A consultation does not obligate you to hire the firm.
Questions about your case
Should I repair the motorcycle immediately?
Preserve photographs and discuss any need for an inspection before repairs, salvage, or disposal. Safety and storage expenses also matter; the best next step depends on the circumstances.
Can an injured motorcycle passenger request a review?
Yes. The available claims and insurance depend on who caused the collision and the relevant policies.
Does the helmet settle who was at fault?
No single fact resolves every issue. Fault for the collision and arguments about how an injury occurred require separate examination of the evidence.
