What If the Other Driver Has No Insurance in California?
A driver having no insurance does not answer every question about your options. Start by separating who caused the crash, what coverage may apply, and what losses you can document.

Check your own policy
Uninsured and underinsured motorist coverages address different situations: an at-fault driver without insurance, or one whose liability insurance is insufficient. Availability and payment depend on the policy and applicable requirements. Do not assume that having an auto policy means you purchased every type of coverage.
Keep injury and vehicle damage questions separate
Coverage for bodily injury and coverage for repairing your car are not interchangeable. Ask your insurer which coverage applies to each part of the claim and what limits or deductibles it identifies. The California Department of Insurance auto guide explains the principal coverage categories.
Bring the policy, not just the insurance card
Collect your declarations page, policy and endorsements, claim letters, report number, photographs, and available loss records. The declarations page is a useful starting point; the policy supplies additional terms. Identify any document you have been asked to sign.
Report promptly and review deadlines
Notify your insurer promptly and check its notice and cooperation requirements. Preserve correspondence and ask for its coverage position in writing. Hit-and-run claims can involve additional reporting and proof requirements. Seek an individual review promptly rather than assuming the ordinary injury lawsuit deadline resolves every insurance deadline.
