What matters after a collision
A useful case review starts with the sequence of events: where each vehicle was, what changed in traffic, and which impact happened first. Rear-end crashes, intersection collisions, and freeway pileups can raise different evidence problems. A police report is useful, but it is not the only evidence that matters.
For a chain-reaction collision on the 110, for example, document whether your car stopped before an impact from behind pushed it forward. Preserve dashcam footage and identify witnesses who saw the first impact. That distinction may matter when drivers give conflicting accounts. This is an example, not a reported firm result.
Evidence to preserve
- Photos of vehicle positions, damage, road markings, and visibility, if safe to obtain.
- Original dashcam files, nearby camera locations, witness contact details, and the report number.
- Medical records and bills, missed-work documentation, and a dated account of how the injuries affect daily activities.
- Insurance communications and the full text of any proposed release.
Insurance and compensation
The review may involve the other driver’s liability policy and applicable coverage under your own policy. Uninsured or underinsured motorist coverage depends on the policy and facts; it is not an automatic second payment. California’s insurance guide explains common coverage types.
Potential damages may include reasonable medical expenses, lost earnings, and pain and suffering where recoverable. There is no reliable settlement multiplier. Fault, causation, documented harm, coverage, liens, and applicable legal limits all affect the analysis.
Reporting and deadlines
A DMV SR-1 report is generally required within 10 days when someone is injured or killed, or property damage exceeds $1,000. It is separate from a police report or insurance claim. Read the DMV requirements.
California’s general deadline for a personal injury lawsuit is two years. A claim involving a California public entity generally requires a separate government claim within six months of accrual, followed by additional lawsuit deadlines. Exceptions and other deadlines can apply; an insurance claim alone does not preserve every deadline. Code of Civil Procedure §335.1; Government Code §911.2.
